not waterproof

I liked this backpack very much until today when i was out in the rain for about 2 minutes with it. It is described as being waterproof but sadly it is not. The top 3" (approximately) of the back (laptop sleeve) was wet. I am beyond annoyed because I can not return it since the tags are no longer attached.
